References to “us”, “we” and/or “our” in these terms and conditions shall mean J.A. & K.E. Parker (ABN 92 720 688 989) trading as Magical Mouse Holidays.

Use of this website and proceeding with your booking through our business acknowledges your acceptance and understanding of the below terms and conditions. These terms and conditions may be amended periodically and you will be deemed to have accepted any amendments if you use the website after those amendments have been posted.

The following categorised headings explain our trading terms with you, the customer:


We act as an agent only for travel service providers and vendors including airlines, accommodation houses, tour and cruise operators and transport services. Our obligation is to make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We are not responsible for, and make no warranty or representation about, third party suppliers, their products and services or information provided on this site about their products and services. All bookings are made on your behalf subject to the terms and conditions and limitations of liability imposed by these service providers. Your legal recourse is against the specific provider and not us. If for any reason, any travel service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not with us.


Pricing is offered to potential clients and customers in a written format, prepared in conjunction with information you have provided to us from website, internet and telephone interaction. We accept no responsibility or liability in any errors in information which you have provided our business for the basis of any quotation, for any type, leg, part or section of travel, accommodation, tour, cruise, stay or transport involved with your planned, booked and or executed holiday or trip.

Pricing is correct at the time of submission of quotation, however is subject to change at any stage prior to our (or nominated agents') acceptance of full payment for a provided quotation. Changes in price may occur for many and varied reasons, and no firm expiry date is offered with any price submitted in either written or verbal form. Occurrences such as transportation charges and levies, annual price rises, fuel levies, unforeseen worldly events, acts of god, natural disasters and currency fluctuations may cause an increase to a previously quoted or discussed price if not paid in full in securing the price offered in a Magical Mouse Holidays formal quotation.

We reserve the right to correct any pricing errors or omissions of fees, charges, taxes or rates before, during or after full payment for quoted travel with Magical Mouse Holidays.

Prices are quoted in the travel suppliers' local currency.


All bookings are subject to the terms and conditions outlined in this document, in addition to the terms and conditions imposed by any supplier with whom you elect to deal with including, but not limited to, terms and conditions relating to the amounts and due dates of deposits and payments.

We reserve the right to pass on your credit card details, and any other essential booking details, to third party suppliers who may charge your card directly for all or part of your booking payment. For details of how we collect and use your personal information, please view our Privacy Policy.

It is your responsibility to ensure the personal details of all travellers are passed on correctly to us, and according to an individual's passport. Magical Mouse Holidays accepts no responsibility for any loss or damage resulting from the provision of incorrect traveller's names or details.

Cancellations, refunds & alterations to booked travel:

Our business reserves the right to be compensated and/or to pass on charges associated with the cancellation or change in travel bookings. Where payment is made to a nominated travel vendor with your credit card details, an additional cancellation fee may be charged by us in processing and completing any available refunds, in full or part thereof as set by the travel supplier. We accept no liability for financial or other loss in funds subtracted by travel providers and vendors in changed or cancelled bookings once paid for in part or full by you, the traveller.

Refunds may take several weeks for processing and reimbursement of funds from a travel or accommodation provider; we accept no liability or responsibility for the time this may take. No refund is available or redeemable after the commencement of the travel quoted and booked.

Changes to flight times:

It is your responsibility to contact the airline prior to departure to ensure there is no change to the scheduled departure time.

Passports, Visas & Health:

It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. You need to ensure that your passport has at least 6 months validity from the date of your return, and some countries require a machine-readable passport. If you are traveling to the United States, including Hawaii, it is now mandatory, under the Visa Waiver Program to receive an electronic authorisation known as ETSA (Electronic System for Travel Authorisation) no less than 72 hours before travel to the USA. You must ensure that you are aware of any health requirements for your travel, and ensure that you carry all necessary vaccination documentation. Please check with your local doctor or specialist vaccination clinic.

Booking and service fees applicable to clients of Magical Mouse Holidays:

As an agent for travel provision, any fees incurred in booking, confirming, changing or amending travel will be borne by the customer. Furthermore, Magical Mouse Holidays have the following applicable fees to various aspects of travel booked through our business as agent for travel. All prices and charges outlined below are listed in Australian dollars and include GST:

  • Credit Card Payments: Our business accepts payment for certain services via MasterCard or Visa. We do not accept American Express, Diners or other charge cards. All credit card transactions (with the exception of fee payments) attract a 3% surcharge, regardless of the monetary amount or the amount & frequency of transactions. No charges will be applicable to Magical Mouse Holidays where your credit card details are provided directly to the end travel provider or vendor; however charges and/or surcharges may be applicable from these providers and vendors. We have no control over the fees and charges set by these companies. Many card companies charge their account holders a transaction fee when the card issuer and the merchant are in different countries. The currency exchange rate and any transaction fees are determined solely by the bank or other agency processing the transaction. This means the amount listed on your credit card statement may be a different figure than that quoted. If you have any questions about these fees or any exchange rate applied to your booking, please contact your bank.
  • Flight Bookings: Domestic flight bookings will incur a non-refundable booking fee of $25 per booking. International flight bookings will incur a non-refundable booking fee of $23 per person. Overseas domestic flight bookings will incur a non-refundable booking fee of $22 per person.
  • Amendments and Cancellations: Changes/amendments to International or Domestic flights will incur a fee of $23 per person, in addition to any supplier fees.

Exclusions in our pricing:

Services made available to you during travel, at an additional cost, are not covered by any partial or full payment you make, nor available for reimbursement in the quotation and subsequent course of travel. Insurances, taxes, levies, tolls, passport costs, visa expenses, medical costs incurred pre, during and post travel, any tips suggested, offered or paid, taxes and food or drink not included in quotation, amongst other things are not cost covered or included in our quotation for travel to you or members of your travelling party (as well as any items of a personal nature), unless otherwise specified in writing in our formal quotation and subsequent travel document.

Some hotel suppliers may require you to present a credit card or cash deposit upon check-in to cover any additional expenses that may be incurred during your stay. You are responsible for the payment of any additional expenses and any deposit taken or amounts charged to your credit card by the relevant hotel are unrelated to any payment made through Magical Mouse Holidays for your hotel booking.

Refusal of Service:

We may choose to refuse your request for quotation if the window of time between quotation to be provided and time of travel is deemed too short for booking confirmation, is impractical, or unviable by staff and/or management of Magical Mouse Holidays. Quotation refusal is at the discrepancy of Magical Mouse Holidays staff and management. Refusal of booking may also apply if the time of acceptance of a previously presented written quotation is deemed too close to the nominated travel date.


Magical Mouse Holidays strongly suggest the purchase of travel insurance coverage prior to the departure of your trip. Depending on the policy selected, travel insurance can cover financial loss for things such as cancelled or delayed flights, lost luggage, medical expenses and theft of your personal possessions. Limits, conditions & exclusions apply. Insurance is issued by Great Lakes Australia (ARBN 127 740 532, ABN 18 964 580 576, AFSL 318603). Any advice provided is general advice only. Please consider your needs, financial situation and the Combined FSG/PDS available from us before deciding to buy insurance.

Limitation of Liability:

Magical Mouse Holidays, to the maximum extent permitted by law, do not accept any liability for any direct or indirect loss (financial or otherwise), inconvenience experienced, expectations not being met, personal injury, illness sickness or death, impact of theft or damage caused to you or anyone else (including breach of contract, tort or negligence) in connection with the use of (or inability to use) this website, the delivery or non-delivery of products or services acquired from Magical Mouse Holidays and any act or omission of suppliers or third parties.

Magical Mouse Holidays will not be liable for cancellation of travel or inability to travel in part or in full due to force majeure, or as a result of Acts of God; such as fire, flood, earthquake, storm, hurricane, monsoon, tidal wave, volcanic activity or any other natural disaster (declared or otherwise), war, invasion, riot, hostilities, political impasse, civil war, rebellion, uprising, revolution, insurrection, military power or takeover, terrorist activity or terrorism, nationalisation, blockage, embargo, labour dispute, strike, lockout, interruption of infrastructure, utility or transport services. We are not responsible for loss of income nor offer any refund in part or in full where acts outside of our direct or indirect control or influence may cause part or complete loss/cancellation before, during or after commencement of travel booked through our business.

We are not bound by or accept liability for the terms and conditions of third parties who provide service to you in your execution of travel quoted by us and booked by us. We do not give guarantees of satisfaction, or any additional guarantee or warranty other than those we are bound to under Australian consumer protection laws.

We do not accept any liability for loss or damage due to the use of any itinerary or planning assistance provided to you, hints or tips, and suggestions we may make or imply, either verbally or in writing. We accept no responsibility or liability should the itinerary plans, which we may sell to you or provide to you free of charge, not meet the satisfaction level expected. Agendas, times suggested and order of attractions we may present are designed as a guide only. Crowd levels, weather, changes to operating hours and show times, and attraction closures may impact the effectiveness of any touring advice and are beyond the reasonable control of Magical Mouse Holidays.


You agree to Magical Mouse Holidays using and disclosing to third parties your contact and personal information as set out in our Privacy Policy.

Law & Jurisdiction:

These terms and conditions and your use of this website are governed by the laws of New South Wales, Australia and you agree to submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
